BIS stops enforcing the AI Diffusion rule and warns on Huawei Ascend chips and diversion
BIS announced it would not enforce the January 2025 AI Diffusion rule, whose compliance date was May 15, 2025, and said it plans to publish a regulation formalizing the rescission and will issue a replacement rule in the future; the rescission rule had not been published as of October 21, 2026. Same-day guidance says using PRC-designed 3A090-level chips, such as Huawei Ascend 910B, 910C, and 910D, may violate General Prohibition 10. BIS also listed 11 diversion red flags and warned that supplying chips, with knowledge they will train models for parties headquartered in China, other D:5 countries, or Macau for WMD or military-intelligence end uses, may require a license under the catch-all controls.
